Using this site and these terms
These terms cover your use of this website and any concrete work you hire Gautier Concrete to do. By using the site, asking for an estimate or signing a proposal with us, you agree to them. If you don't agree, please don't use the site or book work with us.
When we say "we", "us" or "our", we mean Gautier Concrete, a concrete contractor in Gautier, MS. When we say "you", we mean the person using the site or hiring us. Your signed proposal or contract for a job comes first, so if it says something different from these terms, the proposal is what applies to that job.
What we do
We pour and repair concrete for homes and businesses, including driveways, patios, sidewalks, slabs, steps, footings and walls. You can see the full list of services from our home page and read more about our crew on the About page.
What's on this site describes our work in general terms. It isn't a promise that a particular service, finish or timeline fits your property. We confirm that after we see the job in person, and the written proposal sets out the scope.
Estimates and pricing
Estimates are free and come with no obligation. We give them after looking at the site, because the size of the job, the condition of the ground, how much old concrete has to come out, access for the truck and the finish you choose all change the price.
An estimate is our best figure for the work as we understood it on the day we gave it, and it stays good for the period written on it. If the scope changes, or we find something we couldn't see before the work started, such as soft ground under the base, buried debris or roots, we'll stop and talk to you before doing extra work. Any added cost needs your approval first, in writing or by text or email.
Scheduling, weather and cancellation
We set a start date when you accept the proposal. Concrete depends on the weather, so rain, heavy heat or a wet subgrade, the ground the slab sits on, can push the pour back, because pouring in bad conditions makes a weaker slab. If that happens, we'll reschedule with you as soon as we can, and a weather delay isn't a breach by either side.
If you need to cancel or move your date, call us at (228) 263-3738 as early as you can. If we've already ordered material, rented equipment or started the work, you may owe for those costs and for work already done, as your proposal explains.
You agree to give our crew clear access to the work area on the scheduled day, to keep vehicles, people and pets off fresh concrete until we say it's ready, and to tell us about buried lines, sprinklers, septic parts or anything else under the ground that we wouldn't know about.
Permits and property lines
Whether a job needs a permit depends on the work and on your city or county, so check with them before work starts. You're responsible for knowing where your property lines are and for any rules from a homeowners association that apply to your house.
Payment
Your proposal shows what is due, when, and which payment methods we take. Some jobs need a deposit before we order material, and the balance is due when the work is done unless the proposal says otherwise.
If a payment is late, we may pause further work until it's paid, and you'll be responsible for reasonable costs of collecting the amount owed, as far as Mississippi law allows. Concrete contractors may have lien rights on the property they improve, and nothing in these terms gives those rights up.
Our guarantee and what concrete does on its own
Our work is backed by our satisfaction guarantee, and the written proposal for your job sets out exactly what it covers and for how long. If something isn't right, call us and we'll come look at it.
Concrete cracks as it dries and shrinks, and no contractor can stop that completely. We cut control joints, grooves that give the slab a planned place to crack, so cracks tend to stay in those lines, but small hairline cracks elsewhere are normal and aren't a defect. Color and texture can also vary from one pour to the next and from samples or photos.
Our guarantee doesn't cover damage from things outside our control, such as settling of soil we didn't prepare, tree roots, flooding or poor drainage that wasn't part of our job, vehicles heavier than the slab was built for, de-icing salts, chemicals, lack of upkeep, or use before the concrete finished curing, the waiting time while it gains strength. It also doesn't cover work someone else changed or repaired.
Apart from what's written in your proposal, we don't give any other warranty, spoken or implied, including any implied warranty of merchantability or fitness for a particular purpose, as far as the law allows.
Limits on our responsibility
We're licensed and insured, and we take care around your house and yard. Still, some things come with the job, like tire marks on grass from equipment, minor disturbance to plants next to the forms, and dust from cutting. We'll clean up, but we aren't responsible for that kind of ordinary wear from the work.
As far as the law allows, our total responsibility for any claim about a job is limited to the amount you paid us for that job. We aren't responsible for indirect losses, such as lost use of your property, lost income or other costs that follow from a delay or a problem.
This website is for general information. We try to keep it accurate, but we don't promise that everything on it is complete or current, and we aren't responsible for decisions made only on what you read here. Links to other sites are there for your convenience, and we don't control those sites.
If we disagree
If you're unhappy with anything, call us first. Most problems get sorted out quickly when we can look at the work together.
If we can't settle it that way, we both agree to try good-faith negotiation, and mediation if needed, before going to court. These terms are governed by the laws of the State of Mississippi, wherever the work takes place, and any court case will be brought in the county where Gautier Concrete is based, unless the law requires a different place.
Changes to these terms
We may update these terms from time to time, and the new version applies once it's posted on this page. Changes don't alter a proposal you've already signed unless we both agree in writing.
